Terms of Use for Motoship Carsharing Application

Welcome to Motoship App!

Please read these Terms of Use (“Terms”) carefully before using the Motoship App car sharing application (“Application”), Motoship car sharing application (“Service”) operated by FR3 Mobility Limited. (“us”, “we”, or “our”). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

1. Acceptance of Terms
   By creating an account and using the Application, you affirm that you have read, understood, and agree to these Terms, which include an arbitration provision.

2. Account Registration
   You must create an account and provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account and password.

3. Eligibility
   To use the Application, you must be at least 21 years of age and possess a valid driver’s license. Your account must be registered in your own name.

4. Insurance
   Motoship App provides a standard insurance policy covering liability, collision, and comprehensive damage while you are using a vehicle booked through the Application. You may choose to purchase additional coverage through the Application. Please review the insurance documentation provided within the Application for detailed coverage information. Car owners should have a standing insurance policy outside the use of the vehicle on the Motoship carsharing application and services.

5. Vehicle Use
   You agree to use any vehicle accessed through the Application in a safe and lawful manner, in accordance with all traffic laws, and to return the vehicle in the same condition as when it was picked up, barring normal wear and tear.

6. Consent to Safety
   You consent to follow all safety guidelines and instructions provided by Motoship App, including but not limited to the proper operation of the vehicle, adherence to traffic regulations, and the use of safety features within the vehicle.

7. Reporting Accidents or Damage
   You must report any accidents, damages, or thefts involving the vehicle to Motoship App and the local authorities as soon as possible, and in any event within 24 hours of the incident.

8. Prohibited Uses
   You may not use the Application, or any vehicle accessed through it for any illegal or unauthorized purposes, including but not limited to racing, carrying hazardous materials, or engaging in criminal activity.

9. Termination
   Motoship App reserves the right to terminate your access to the Application at any time for violation of these Terms or any unlawful or unsafe behavior.

10. Changes to Terms
    Motoship App may modify these Terms at any time. Your continued use of the Application after any modification confirms your acceptance of the new Terms.

11. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Motoship App operates, without giving effect to any principles of conflicts of law.

12. Liability
    While utilising the Motoship carsharing application or service Motoship carsharing Application is liable for damages resulting from fatal injury, bodily injury, and loss of health, which were caused by negligent violation of the obligations of a legal representative or assistant. Liability is specifically limited to intentional and gross negligence.

Motoship carsharing application and service providers may collect information from the rental vehicle which may include data about the vehicle’s location, speed, distance travelled and operation. As a member you agree that the rental company and service providers can, subject to the applicable law, use and share any of this information to: (a) provide services to me; (b) assist emergency service providers, or other, as reasonably needed; (c) check or maintain the vehicle; (d) develop new products and services and improve existing ones; (e) enforce this Agreement; (f) prevent fraud, abuse or misuse of the services; (g) comply with legal requirements, including valid court orders and subpoenas; or (h) protect the rights, property, or safety of the member or others. Motoship carsharing Application provide service through wireless, telematics and other common carrier networks, they cannot guarantee that communications will not be intercepted by others. Members agree not to hold the company and its service provider companies liable for any damages for loss of privacy occurring in communication over such networks.
